Kindly note that any proposal to be considered by the Members of the United Nations must first be presented by an official representative (Ambassador) of a Member State, duly inscribed on the Organization’s agenda and voted by the Membership. Human Rights Watch urges the Vietnamese government to:
Immediately and unconditionally release Khmer Krom Buddhist monks who have been imprisoned or placed under house arrest or pagoda arrest in Vietnam for the peaceful expression of their political or religious beliefs.
Allow Khmer Buddhists to freely conduct peaceful religious activities in accordance with international legal standards.
Lift restrictions on Khmer-language publications in Vietnam and end the banning and confiscation of Khmer Krom human rights advocacy materials, including videotapes and printed bulletins. Cease the harassment of arrest of people for disseminating such publications or videos.
Cease harassment, intimidation, and imposition of criminal penalties on individuals who are in contact with international organizations, including groups that specifically advocate for the rights of Khmer Krom people.
Allow UN special rapporteurs and human rights organizations to freely conduct field research in the Mekong Delta and monitor the human rights situation there. Allow international human rights organizations and UN agencies, as well as family members, to visit Khmer Krom prisoners.
Human Rights Watch urges the Cambodian government to:
Abide by the 1951 Refugee Convention, to which Cambodia is a state party, by not returning individuals to countries where their lives or liberty would be threatened. Provide Khmer Krom who have fled from Vietnam and who are not granted Cambodian citizenship the right to seek asylum. Do not deport to Vietnam Khmer Krom with a well-founded fear of persecution in that country.
Call on the Vietnamese government to allow Khmer Krom monk Tim Sakhorn, a Cambodian citizen who was released from one year’s imprisonment in Vietnam on spurious charges in May 2008, to freely return to his home in Cambodia, should he choose to do so.
Conduct a thorough investigation into the murder of Khmer Krom monk Eang Sok Thoeun in Kandal Province, Cambodia, on February 27, 2007, and bring the perpetrators to justice.
Methodology
This report is based on research conducted between December 2007 and December 2008. Detailed interviews were conducted in Khmer language with Khmer Krom communities in Vietnam, Cambodia, Thailand, Australia, and the United States.
Field research in Vietnam was conducted in March 2008 in the Mekong Delta provinces of Soc Trang, Tra Vinh, Long An, Vinh Long, Can Tho, and An Giang, where Human Rights Watch conducted interviews and conversations in Khmer with Khmer Krom Buddhist monks in their pagodas and with members of the Khmer Krom community. Human Rights Watch has withheld all identifying details of these persons to protect their safety. (Cf. Human Rights Watch: World Report 2011 on Khmer Krom in Vietnam – Events of 2010)
All crucial points stated above were specifically related to crimes of genocide and crimes against humanity perpetrated by both Vietnam and Cambodia against the indigenous Khmer Krom peoples, the rightful and legitimate owners of their Homeland and Motherland, Kampuchea Krom territory pursuant to Articles 5, 6, and 7 of the Rome Statute of the International Criminal Court (ICC). Cambodia and Vietnam, which are both full-fledged Member States of the United Nations must abide by the Rule of Law of the UN and must respect all international laws they have adopted, signed, and or ratified. The deliberate violation of the people’s five categories of human rights must be ended once and for all, and the international community, the United Nations system and bodies as a whole, in particular the United Nations Secretary-General shall not overlook and ignore that kind of human rights violations which have been persistently perpetrated against the dependent people by any Member State or Member Nation of the United Nations, without obeying and respecting the United Nations Rule of Law, the United Nations Charter, the United Nations General Assembly Resolutions, Declarations on the Situation, and all related International Treaties, to which the violating country concerned has recognized, adopted, signed, and or ratified.


Why Do we Need an International Criminal Court?
To achieve justice for all
For nearly half a century – almost as long as the United Nations has been in existence – the General Assembly has recognized the need to establish such a court to prosecute and punish persons responsible for crimes such as genocide. Many thought… that the horrors of the Second World War – the camps, the cruelty, the exterminations, the Holocaust – could never happen again. And yet they have. In Cambodia, in Bosnia and Herzegovina, in Rwanda. Our time – this decade even – has shown us that man’s capacity for evil knows no limits. Genocide … is now a word of our time, too, a heinous reality that calls for a historic response.”

Final words of the author of the present Brochure for Non-Self-Governing Kampuchea Krom Territory and Indigenous Khmer Krom Peoples, the rightful and legitimate owners of the land:
Kampuchea Krom, the Homeland and Motherland of the Indigenous Khmer Krom Peoples must absolutely be returned to the indigenous Khmer Krom peoples, the rightful and legitimate owners, without any conditions, restrictions, and or reservations whatsoever, or the Five Categories of Human Rights Violators will be punished

The present Brochure is the golden product of the author who tirelessly works hard through the legi-timate utilization of all the existing international law on the Situation to better educate the universe to better understand the real status of Kampuchea Krom Territory or Cochinchine and the real identity and actual situation of its peoples, the Khmer Krom peoples.

The present Brochure is just a powerful complement to the Decolonization-Proposal which was formally submitted to His Excellency Mr. Ban Ki-moon, the Secretary-General of the United Nations, all Member States, all United Nations bodies and system, all United Nations Permanent Observers and all international NGOs and especially the Department of Public Information of the Secretariat (DPI) and the United Nations Multimedia Library for publication and research purposes.

Even though the legitimate appeal and request for the decolonization of the Non-Self-Governing Kampuchea Krom Territory is not yet underway and is not yet taken care of by the international commu-nity, Member States, the United Nations system as a whole and other governmental and non-governmental organizations, and especially the United Nations Secretary-General and the Special Committee on the Situation in cooperation with Vietnam, the administering Power to work on the decolonization of the territory in accordance with the United Nations General Assembly Declaration 1514(XV) of 14 December 1960, the United Nations General Assembly Resolution 1541(XV) of 15 December 1960, the United Nations General Assembly Declaration on the Rights of Indigenous Peoples of 13 September 2007 and the 2001-2010 Second International Decade and its plan of action for the Eradication of Colonialism, the Indigenous Khmer Krom Peoples still believe and hope that the world’s top leaders will never let them down and never ignore their greatest will and highest aspirations to eradicate colonialism in the whole world in the twenty-first century. Why? Because they are the principal makers of those international laws such as treaties, declarations, and resolutions and all other international instruments, and if they don’t respect and abide by their own laws, who else on this planet Earth is going to respect and abide by those man-made international laws?

The Kampuchea Krom Territory National Leadership Decolonization Task Force – a National Movement for Kampuchea Krom Independence - is moving forward with great momentum in the right direction and doing the right things at the right time and in the right place. Why? Because our Organization and our Movement is the very pure and very clean sanitary Water that can flow along the United Nations Channel and is the Ship that can sail through the United Nations Channel while acting on behalf of all Khmer Krom Organizations and Institutions around the globe. Our Organization and Movement follows strictly our political profile which is included in the appendices to the present Brochure as our moral, ethical, and political principles and guidelines to successfully achieve complete independence and freedom for our Non-Self-Governing Kampuchea Krom Territory and our Non-Self-Governing Khmer Krom Peoples, the rightful and legitimate owners of the territory.

Therefore, our Organization and Movement’s active members and supporters greatly hope that sooner or later the freely expressed will and desire of our suffering Khmer Krom peoples in their legitimate pursuit of their lost rights, freedoms, and powers to be restored and or reinstated by the international solutions will gain momentum and will be successful to their intended result, greatest wills and aspirations in the very nearest future.

Get actively involved by not staying on the sidelines and waiting to see who the winners are and who the real losers are in this legitimate fight for the rebirth and new life of a territory and a people who strive to get World’s attention, their lost rights, freedoms, and powers equitably restored and reinstated sooner or later by international solutions. In this legitimate fight every person of conscience and a level playing field can provide an educational guess that the indigenous Khmer Krom peoples are the final real winners and France and its colluding partner, Vietnam are the final real losers because in terms of “cause” and “effect” relationship, France and its colluding partner, Vietnam, who had caused an abyss of cruel suffering to the indigenous Khmer Krom peoples for decades and decades and for generations and generations must receive what they deserve as the”effect” in positive correlation with the“cause” they have done to the victims, the Khmer Krom peoples. As a bad “effect” of their illegitimate actions, France and Vietnam must be severely punished for their illegitimate actions against the indigenous Khmer Krom peoples who have suffered for so long and whose atrocious and inhumane suffering were and are ignored by the international community, especially the United Nations. But in the end, whatever happens to the indigenous Khmer Krom peoples, the bright light of freedom, liberty, and democracy with a brilliant future will shine at the end of the tunnel and finally justice will prevail; all human rights violators, criminals and terrorists will deserve their sentence for their deliberate crimes committed against the innocent, small and powerless peoples, nations and territories on this planet Earth.
