ADDENDUM
The most recent human rights violations perpetrated by a group of
over two hundred (200) Vietnamese people against the
indigenous Khmer Krom peoples of Kampuchea
Krom (Former French Cochin China, present southern Vietnam) on 2 September 2010 in Raung Damrey province
(renamed Tay Ninh by Vietnamese
government)

1.An indigenous Khmer krom young man, Chau Net, a laborer of a Vietnamese rubber plantation in Raung Damrey province (renamed Tay Ninh by Vietnamese government) was hacked to death
on 2 September 2010 by a group of
over 200 Vietnamese people working in the same rubber plantation. Two of his Khmer Krom co-workers, Chau Phat
and Chau Keo, were seriously injured and
five others were slightly injured among 22 Khmer Krom laborers. Chau Phat died of his serious injuries on 7 September 2010.
The Vietnamese local authorities, instead of doing the
investigation of the crimes and instead of seeking justice for the victims and
their families, have threatened them not to disclose these horrible crimes to
the outside world. If they did, they
will be severely punished by the Vietnamese local authorities. But the families of the victims were forced
to say against their own will that those victims were killed and injured due to
the traffic accident instead.
These crimes against humanity perpetrated by Vietnam against the Indigenous
Khmer Krom Peoples for
generations are not uncommon among all indigenous Khmer Krom peoples because
the successive Vietnamese governments and Vietnamese people continue to
practice their systematic
and coordinated
plan to wipe out Khmer Krom peoples from the world’s map as proven
black and white by our Decolonization-Proposal to the United Nations.
Those Vietnamese people who have committed such horrible crimes
against the innocent indigenous Khmer Krom peoples were said to have been
instigated by the evil male spirit of Neak Ta “Ong Bo” to kill Khmer Krom peoples off their
Homeland. This is very true because the
Vietnamese government has its systematic and coordinated plan to kill off Khmer
Krom peoples
from their own ancestral Homeland and thus they took this makeup
event as a pretext to continue to easily kill Khmer Krom peoples who are the
rightful and legitimate owners of the lands. This evil male spirit of Neak Ta “Ong Bo” happens once every year to instigate
Vietnamese people to continue to kill again and again Khmer Krom peoples. The families of all the victims appeal to the
international community especially the United Nations to seek justice for their
slain child and their seriously and slightly injured children by pressuring
Vietnam to investigate the crimes in order to take the criminals to the court
of law to punish them for the horrible crimes they have committed.

3. Venerable Khmer Krom Buddhist
monk, Thach Sophon, Abbot of Kampong
Kasann pagoda in Kampuchea Krom territory (southern Vietnam) was coerced to
disrobe by the Vietnamese authorities on July 22, 2010. And a week later, July 29, 2010 at 11:00
a.m., Thach Sophon was arrested by the police of Preah Trapeang province
(renamed Travinh by Vietnamese government).
Up to date, his whereabouts are still unknown to his family and his
Khmer Krom Buddhist followers. The root
causes of his defrocking and arrest were as follows:
- He was so active in promoting and encouraging his monk students
to go study abroad such as going to study in Thailand’s universities;
- He has encouraged students to access global information and news
by using communication devices
such as satellite dish; and
- He took safety and security measures to protect his temple from
vandalism and theft of artifacts by bad people.
3.
Venerable
Khmer Krom Buddhist monk, Thach Preichea Koeun, columnist/writer of Preynokor
newspaper in Cambodia was under constant threat of arrest by the Cambodian
authorities in cooperation with the Vietnamese government, forcing him to stop
writing articles for Preynokor news-paper.
The motive of his threat of arrest was his asking some Cambodian young
men to help circulate the paper on the streets of Capital City Phnom Penh. On April 5, 2010, the Ministry of Religion’s
security agents and the officials from other Cambodian government agencies came
to arrest him at Watt BotumVattey in Phnom Penh where he used to live. He escaped to stay in Watt Ang Phor Thi
Nhieng on June 1, 2010, but on August 21, 2010 under the pressure of the secret
agents from the Ministry of Religion and those of Prime Minister Hun Sen, the
Abbot of the pagoda asked him to leave the temple immediately. On August 27, 2010, the Abbot of Angtaming,
Venerable Danh That gave him permission to stay temporarily in the
monastery. But not just a full day of
stay in that temple, the officials of the Ministry of Interior under the
directives of the officials from the Vietnamese Embassy in Phnom Penh and the
Hanoi government telephoned directly to Venerable Danh That to expel Venerable
Thach Preichea Koeun from the temple without conditions. On August 27, 2010 at 9:00 p.m., Venerable
Danh That asked Venerable Thach Preichea Koeun to leave the temple
immediately. If he did not want to leave
the temple, he must sign an agreement to stop writing articles for the
paper. And on August 29, 2010, the
Interior police ordered Venerable Danh That, Abbot of the pagoda to confiscate
his passport and monk ID card and papers.
These actions of the Hanoi’s Embassy in Cambodia and the Hanoi
government were against the international law.
Such interference in the internal affairs of Cambodia by Hanoi will not
be tolerable
by the international
community and the United Nations of which Vietnam is a full-fledged Member
State.

Vietnam’s persistent violations of the
Indigenous Khmer Krom Peoples’ human rights, fundamental freedoms and the right
to exercise the right to self-determination in international law

Regarding the persistent violations of the Indigenous Khmer Krom
Peoples’ human rights, fundamental freedoms, freedoms of practice and worship
of Theravada Buddhism, and right to exercise the right to self-determination in
international law by the Socialist Republic of Vietnam
(SRV)
We, the undersigned, Khmer Krom peaceful protesters, Khmer Krom
Buddhist monks, all Khmer people in general around the globe, Supporters and
Friends, Considering the French Republic, by its law no. 49-733 of 4 June 1949,
transferred its colony of Cochin China or Kampuchea Krom, the homeland of Khmer
Krom to the Vietnamese Emperor Bao-Dai without the plebiscite of the Indigenous
Khmer Krom Peoples,
Considering President George W. Bush’s endorsement for Hanoi’s
admission into the World Trade Organization at the 2006 Asia Pacific Economic
Cooperation Meeting in Hanoi, the removal of Vietnam from a list of a Country
of Particular Concern (CPC), and the granting of Permanent Normal Trade
Relations (PNTR) between Vietnam and the United States which were all based on
Vietnam’s superficial improvement of its human rights record,
Considering the Membership of Vietnam to the United Nations, the
U.S.-Vietnam’s Permanent Normal Trade Relations (PNTR), the World Trade
Organization (WTO) for which Vietnam was not entitled to because of its
endless, ongoing, continuous nonstop human rights violations against the
Indigenous Khmer Krom Peoples, the Montagnards, the Hmongs, other ethnic
minorities groups, and other people in Vietnam,
Considering the cancellation of scheduled films to be screened at
the 22 May 2007, Sixth Session of the UNPFII in New York: one film, “Hunted
Like Animals” depicting the story of the Hmong Lao people, hiding and starving
in remote mountainous jungles for over 30 years—forced by military aggression
to flee their homeland and become refugees, and another film, “Eliminated
Without Bleeding” depicting the atrocious and inhumane colonial rules of Vietnam
over the Indigenous Khmer Krom Peoples,
Considering the most recent brutal defrocking of Venerable Tim Sakhorn, Abbot of Wart
North Phnom Den, Kirivong district, Takeo province, Cambodia, and his
mysterious deportation to be incarcerated in Vietnam in flagrant violation of
Buddhist laws, disciplines and teachings and the supreme law of Cambodia, the
state Constitution,

Considering five Khmer Krom Buddhist monks who have been arrested,
defrocked and sentenced to two and four years in prison for staging peaceful
demonstration demanding the Vietnamese local authorities to stop violating
Khmer Krom Buddhist monks’ religious rights and freedoms, Considering sixteen
Khmer Krom Buddhist monks who protested against Vietnamese authorities in
Khleang province got arrested and defrocked,
Considering seven Khmer Krom Buddhist monks who have been arrested
and then disappeared since the peaceful demonstration in Khleang province on 22
February 2007, Considering the impunity culture of Vietnam that is often and/or
always overlooked by the United Nations and the international community, its
members and institutions regarding human rights, especially the persistent
human rights violations and the extrajudicial killings of the Indigenous Khmer
Krom Peoples, the Montagnards, the Hmongs, other ethnic minorities and other
people in Vietnam, Considering the interference of Hanoi’s authorities in our
Khmer Krom’s Theravada Buddhism affairs by forcing Khmer Krom Buddhist monks to
be integrated into and be placed under the control of the Vietnamese United
Buddhist Association in order to eliminate Khmer Krom ‘s Theravada Buddhism,
Considering the Principles contained in the Charter of the United
Nations, especially Chapter II, Article 6 regarding Membership, Chapter XI
(Declaration Regarding Non- Self-Governing Territories), Chapter XII
(International Trusteeship System), and Chapter XIII (The Trusteeship Council),
Considering the international treaties, conventions and covenants
regarding human rights that Vietnam is one of the signatories,
Considering the United Nations General Assembly resolution 15
14(XV) of 14 December 1960 regarding the declaration on the granting of
independence to colonial countries and peoples, Considering the United Nations
General Assembly resolution 1541 (XV), which complemented the Declaration on
decolonization, affirmed that there were three ways in which a
Non-Self-Governing Territory could attain a full measure of self-government, as
envisaged in the Charter. These three ways were: a) Free association with an
independent State as a result of a free and voluntary choice by the people of
the Territory expressed through an informed and democratic process; b)
Integration with an independent State on the basis of complete equality between
the peoples of the Non-Self- Governing and those of the Independent State; c)
Independence. Whatever option is chosen by the peoples of a Non-Self-Governing
Territory, this choice must be the result of the freely expressed wishes of
these peoples,
Considering the 2001-2010 Second International Decade and its Plan
of Action for the Eradication of Colonialism in the 21St century,
Considering the UNPO’s document that stated, “The international community, its members and
institutions have an obligation to act where international law, including human
rights and especially the right to self-determination, is violated. The time to
act is always now, not when a conflict is “ripe” for resolution, as some would
have it.”,
Considering the two UNPO’s letters dated respectively 02 and 05
September 2003 to H.E. Phan Van Khai, Prime Minister of the Socialist Republic
of Vietnam (SRV) appealing and requesting him to decolonize Kampuchea Krom and
to place it under the United Nations’ control,
Considering the recent proclamation of the United Nations Human
Rights Council regarding the rights of the indigenous peoples,
Considering the Universal Declaration of Human Rights, Considering
the ongoing, continuous non-stop violations of the Indigenous Khmer Krom
Peoples’ human rights, fundamental religious freedoms and recognized and
guaranteed right to self-determination and independence by the Socialist
Republic of Vietnam,
Considering the persistent human rights violations of Vietnam
against the Indigenous Khmer Krom Buddhist monks and Khmer Krom Peoples since
22 February 2007 in Kampuchea Krom and in Cambodia and recently the brutal and
illegal defrocking and the forced deportation and the illegal incarceration of
the former Venerable
Tim Sakhorn, Abbot of Watt Phnom Den North of Kirivong district,
Takeo province, Cambodia, falsely accusing him of working for the Khmers
Kampuchea Krom Federation (KKF), of illegally crossing the border to Vietnam
and of undermining the good friendship relation
Vietnam’s

between
Cambodia and Vietnam,
Considering
the global peaceful demonstrations of Khmer Krom peoples, Khmer
Krom
Buddhist monks and their friends and supporters in Australia, USA, France,
Canada and Cambodia urging the release of Venerable Tim Sakhorn from jail in
Vietnam and his return to Cambodia for trial, if any, because of his innocence
and of his Khmer nationality, not Vietnamese’s
Considering
the persistent appeals and requests of the local and international human rights
organizations to find Venerable Tim
Sakhorn’s whereabouts, to release him unconditionally from jail in Vietnam
and to send him back to Cambodia, and also to fmd out any Cambodian officials
and authorities who were involved in his forced deportation to Vietnam after
defrocking that was in flagrant violation of the Buddhist laws, Buddhist
teachings and the Cambodian Constitution,
Considering
the excellent remarks of H.E. Dr. Asha-Rose
Migiro, UN Deputy Secretary-General at the opening of the 2007 session of
the Special Committee on decolonization in New York, 22 February which stated, “The United
Nations and the international community have a responsibility to bring about a
speedy, successful and sustainable solution for the total eradication of
colonialism. And, if we are to close this chapter in human affairs,
we need to focus on pragmatic steps.”, TRONGLY urge the United Nations and the
international community to urgently respond to the following appeals, requests
and suggestions as matters of priorities for the survival and the dignity of
the Indigenous Khmer Krom Peoples of the Southern Vietnam or the former French
Cochin China or Kampuchea Krom in Khmer, their ancestral homeland for thousands
of years as evidenced by their Khmer race, heritage, creed, belief, culture,
language, customs, traditions, hundreds of Buddhist temples and Pali schools,
and inscriptions in wood and in stone etc.:
1) Must
reinstate the economic embargo on Vietnam for its persistent human rights
violations against the Indigenous Khmer Krom Peoples, the legitimate and
rightful owners of the Territory, the other indigenous minorities, ethnic
minorities groups and other people in Vietnam;
2) Must
expel Vietnam from the world body for its persistent violations of the
Principles contained in the UN Charter;
3) Must
include Kampuchea Krom or former French Cochin China or Southern Vietnam or the
Mekong Delta region in the list of countries and peoples to decide for their
future;
4) Must open
the UN Human Rights Offices in the Mekong Delta region where the Indigenous
Khmer Krom Peoples are living in greater communities; 5) Must have periodic
visiting missions of the United Nations Rapporteurs on the situation of Human
Rights, Religious Freedoms, Women Rights and Children to the Mekong Delta
region;
6) Must have
at least one or two visiting missions of the UN Deputy Secretary-General to the
Mekong Delta region or other UN officials as the official Representatives of
the UN Secretary-General in formal execution and practical application of the
UN GA Resolution 2001-2010 Second International Decade for the Eradication of
Colonialism and its Plan of Action in the 21st century;
7) Pressure
Vietnam to immediately release all Khmer Krom Buddhist monks from jails and to
re-ordain them in accordance with the Buddhist laws, disciplines and teachings;
8) Pressure
Vietnam to comply fully with the UN GA Resolution 2001-2010 Second
International Decade and its Plan of Action for the total eradication of its
colonialism over Kampuchea Krom and Khmer Krom Peoples by cooperating with the
UN bodies, the UN system, the international organizations, and the NGOs to help
Khmer Krom Peoples to exercise their right to self-determination as a matter of
priority in accordance with the UN GA resolutions l5l4(XV) of 14 December 1960
and l541(XV) of 15 December 1960;
9) Punish
Vietnam for its persistent and flagrant human rights violations against the
Indigenous Khmer Krom Peoples, the legitimate and rightful owners of the
Territory, the Montagnards, the Hmongs, the other ethnic minorities groups and
other people in Vietnam;
10) Pressure
the Cambodian Government to demand Vietnam to immediately

former Venerable Tim Sakhorn from
jail in Vietnam and to send him back unconditionally and without delay to
Cambodia;
11) Pressure
the Cambodian government to severely punish those ministerial, departmental,
provincial, and local district, commune and village officials and authorities
that were involved in the illegal defrocking and forced deportation of Venerable Tim Sakhorn, Abbot of Watt
North Phnom Den to Vietnam;
12) Pressure the Cambodian government, especially the Ministry of
Culture and Religion to fire the Patriarch
Non Nget and the Highest Patriarch Tep
Vong from the monasteries for both supreme chiefs monks are not really
representing nationally Khmer Theravada Buddhism and Khmer Buddhist monks in
general, but the Hanoi Communist Central Party’s monks of 7 January 1979;
13) Faithfully help and assist the Indigenous Khmer Krom Peoples
to exercise their right to self-determination and independence in accordance
with the current international law through the dialogues with Vietnam, the
administering Power in order to prepare for and set up the self-determination
referendums as the UN used to do for the Tokelau people in New Zealand and for
other non-self-governing countries and territories in the past decades;
14) Must avoid the big mistake committed by the UN in the past
decades by granting the international seat and or floor to the Khmer Rouge Pol Pot and his clique to
voice their cheap and dirty lies to the world that Khmer people under their
great and clairvoyant leadership ate three times a day including dessert. But
ironically, Khmer people were starved to death, exposed to hardship and mass
execution without being known to the world and without checking on their lies
by the United Nations until about two million innocent lives were perished
during the Pol Pot time or the Killing Field. Therefore, the United
Nations and the international community must keep their eyes on the very real,
true suffering of the Indigenous Khmer Krom Peoples that have been oppressed,
persecuted, prosecuted, tortured, imprisoned, murdered, suppressed, eliminated
without bleeding, etc. by the atrocious colonial rules of Vietnam;
15)Decolonize Kampuchea Krom or former French Cochin China or Southern Vietnam
or Mekong Delta region and place it under the United Nations’ control; and
16) Finally, if Vietnam,
as a United Nations’ Member State or Member Nation, will not honor the
international law, especially the UN Charter, Chapters XI, XII, XIII, the two
UN landmarks resolutions 15l4(XV) and 1541(XV) of respectively 14 and 15
December 1960, and the 2001-20 10 Second International Decade and its Plan of
Action for the Eradication of Colonialism in the 21st century,
Must take Vietnam to the International Court of Justice (ICJ) to
be tried for its endless human rights violations and its hate and racial crimes
against the Indigenous Khmer Krom Peoples, the legitimate and rightful owners
of Kampuchea Krom for centuries. Made in Saint Paul, the Capital of the State of

Regarding
the Right to Self-Determination and Independence and the Political Status of

Kampuchea Krom territory also Known as Cochin
China or southern Vietnam by
virtue of Article 3 of the 13 September 2007 United Nations Genera] Assembly
Declaration on the Rights of Indigenous Peoples, and in accordance with the
spirits, dispositions, provisions, stipulations and principles contained
especially in the United Nations Charter. Chapters XI, XII, and XIII, the
United Nations General Assembly resolution151 4(XV) of 14 December 1960
regarding the Granting of Independence to Colonial Countries and Peoples, the
UN GA resolution 1541 (XV) of 15 December 1960 regarding the option for three
different forms or models of self-determination
such as Free
association with an independent State, Integration with an independent State,
and Independence, and the 2001-2010 Second International Decade and its Plan of
Action for the Eradication of Colonialism in the 21St century.
Recalling
the French Republic under President Vincent Auriol’s administration, by its law
number 49-733 of 4 June1949, had transferred its colony of Cochin China also
known as Kampuchea Krom, the ancestral homeland of Khmer Krom peoples to
emperor Bao-Dai of Vietnam without consultation with the Khmer King and without
the plebiscite and mutual agreement or consent of the legitimate and rightful
owners, the indigenous Khmer Krom peoples in flagrant violation of the Charter
of the United Nations, in particular Chapters XI. XII and XIII, of which France
has been Member State since 24 October 1945,
Considering
that the recognition of the inherent dignity and of the inalienable rights of
all members of the human family to which the Indigenous Khmer Krom Peoples of
former French Cochin China belong is the foundation of freedom, justice and
peace in the world,
Considering
that these inherent dignity, basic human rights, fundamental freedoms. and
inalienable rights to which all Indigenous Khmer Krom Peoples are entitled, by
virtue of the Universal Declaration of Human Rights of 10 December 1948 have
been persistently violated by the government of Vietnam,
Recalling
the petition dated 1 September 2007 regarding primarily the inclusion of
Kampuchea Krom on the list of non- self-governing territories to decide their
future, the decolonization of Kampuchea Krom and its placement under the
control of the United Nations, the punishment of Vietnam for its persistent
violations against the human rights, fundamental freedoms and the right to
self-determination of the Indigenous Khmer Krom Peoples.
Recalling
H.E. Kong Korm, President of the 7th Commission of the Senate of the Kingdom of
Cambodia’s letter dated 26

of the French Republic whose copy was sent to the United Nations asking the
French Senate, French National Assembly and French Government to revise and
resolve the problem of Kampuchea Krom territory,
Recalling King Norodom
Sihanouk’s public message of 8 June 2003 in strong support of the Cambodian
Community of Kampuchea Krom’s resolution reinterring the Parliament and French
government to repeal France’s law number 49-733 of 4 June 1949 illegally
transferring her colony of Cochin China to emperor Ban Dai of Vietnam without
consultation with and consent of the Khmer King and Khmer Krom peoples, the
legitimate and rightful owners of Cochin China or Kampuchea Krom,
Expressing appreciation and profound respect and gratitude for
H.E. Asha-Rose Migiro, Deputy
Secretary-General of the United Nations whose excellent remarks, “ Pragmatic
Steps Needed to Close Colonial Chapter in Human Affairs” at the 22 February
2007 opening session of the UN Special Committee on Decolonization in New York,
requesting the UN Special Committee on Decolonization, all UN bodies, all
administering Powers and all international organizations and institutions to
cooperate with each other to “bring about a speedy, successful and sustainable
solution for the total eradication of colonialism.”.
Recalling the Universal Declaration of Human Rights adopted and
proclaimed by the United Nations General Assembly on 10 December 1948, calling
upon all UN Member Countries to publicize the text of the Declaration and to”
cause it to be disseminated, displayed, read and expounded principally in
schools, and other educational institutions, without distinction based on the
political status of countries or territories.”, and to promote respect for
these rights and freedoms, to secure their universal and effective recognition
and observance, both among peoples of the United Nations Member States and
among peoples of territories under their jurisdiction,
Recalling the letter to H.E. Ban Ki-moon, UN Secretary-General
urging him to consider I) putting Kampuchea Krom or former French Cochin China
or southern Vietnam on the list of the territories still to decide their future
and to get help, assistance and support from the UN Special Committee on
Decolonization; 2) pressing Vietnam to fully comply with the UN GA resolutions
151 4(XV) of 14 December 1960 regarding the Granting of Independence to
Colonial Countries and Peoples, 1541 (XV) of 15 December 1960 regarding the
option for three different forms or models of self-determination-- Free
association with an independent State, Integration with an independent State
and Independence--, the 2001-2010 Second International Decade and its Plan of
Action for the Eradication of Colonialism in the 21st century, the UN Human
Rights Council Proclamation, and the two letters of the UNPO of 2 and 5
September 2003 requesting Vietnam to decolonize Kampuchea Krom and to place it
under the control of the United Nations for the preparation of the self-
determination referendum allowing the Khmer Krom Peoples to choose among the
options stipulated in the UN GA resolution 1541 (XV) of 15 December 1960; 3)
Envisaging the mission of the UN Special Rapporteurs on the situation of Human
Rights, Religious Freedoms, Political, Social, Economic Development, Cultural
and Educational Advancement, Natural Resources, etc to the Mekong Delta Region
where the Indigenous Khmer Krom Peoples are living in greater communities; 4)
Helping to set up dialogues with Vietnam, the administering Power regarding the
decolonization of Kampuchea Krom and place it under the control of the United
Nations; and 5) Planning for a self-determination referendum allowing the Khmer
Krom peoples to use their own free wills for their self-government like the UN
used to do for the Tokelau people in New Zealand and the East Timorese in Indonesia,
Expressing great appreciation for H.E. Ban Ki-moon, UN
Secretary-General citing “Unfinished Business” and calling for renewed
commitment to eradicate colonialism at the UN Special Committee on
Decolonization on 27 February 2009 in New York stating that” under the Charter,
the administering Powers have a special obligation to bring the territories
under their administration to an appropriate level of self-government”, hoping
the administering Powers will work together with the Special Committee and the
peoples in the territories to find the appropriate format and timing for the
completion of decolonization in each territory.”,
Recalling the email message on Wednesday 25 July 2007 to H.E. Mr.
Jean-Marc de La Sabliere, Ambassador Extraordinary and Plenipotentiary
Permanent Mission of France to the United Nations urging him to request the
French government to repeal the law number 49-733 of 4 June 1949 illegally
transferring Cochin China or Kampuchea Krom, the ancestral homeland of Khmer
Krom Peoples to Bao-Dai and unconditionally return Kampuchea Krom territory to
the legitimate and rightful owners, the Khmer Krom peoples in conformity to the
spirit, provisions, dispositions, stipulations and principles of all existing
international laws,
Considering that the United Nations General Assembly Declaration
of 13 September 2007 on the Rights of Indigenous Peoples whose Article 3 grants
the indigenous peoples specifically the right to self-determination and
especially the right to freely determine their political status and freely
pursue their economic, social and cultural development,
Now, Therefore the Indigenous Khmer Krom Peoples, the legitimate
and rightful owners of their ancestral homeland Kampuchea Krom territory, or
southern Vietnam, formerly French Cochin China that French Republic under the
administration of President Vincent Auriol, had illegally transferred to Ban
Dai of Vietnam without consultation with the King of Cambodia and without the
consent of the legitimate and rightful owners, the Khmer Krom Peoples,
In close observation, pure application, execution and great
respect for the Universal Declaration of Human Rights, the United Nations
Charter, Chapters XI, XII, and XIII, the UN GA resolution I5l4(XV) of 14
December 1960 regarding the Granting of Independence to Colonial Countries and
Peoples, the UN GA resolution 1541 (XV) of 15 December 1960

or models of self-determination such as either Free association with an
independent State or Integration with an independent State or Independence, the
2001-2010 Second International Decade and its Plan of Action for the
Eradication of Colonialism in the 21st century, and finally the UN GA
Declaration on the Rights of Indigenous Peoples dated 13 September 2007 where
144 Member States adopted including France and Vietnam, the top major players
in the long lasting abyss of sufferings endured for decades and decades by the
Indigenous Khmer Krom Peoples, the legitimate and rightful owners of their
ancestral homeland Kampuchea Krom territory also known as former French Cochin
China or present southern Vietnam,
I. Decide by absolute majority voices
and votes and in line with the spirits, dispositions, provisions, stipulations
arid principles of all existing international laws and in positive correlation
with the wills, desires, wants, needs and aspirations of the world leaders,
theirs and the international organizations and institutions above-referenced to
freely determine the political status for Kampuchea Krom territory and Peoples
as fully sovereign and independent territory and fully sovereign and
independent peoples from the State of Vietnam, rejecting thereby any proposed
forms of self-determination by either Vietnam, the administering Power or by
the United Nations, its bodies and or international organizations and
institutions.
2. Reiterate the official recognition of
Kampuchea Krom territory and dependencies by the United Nations General
Assembly as non-self-governing territory and its registration on the list of
the United Nations Special Committee on Decolonization (Committee of 24) to be
decolonized and placed under the control of the United Nations.
3. Urge the UN Secretary-General to
begin either formal or informal consultations with the Governments of Vietnam
and France aimed at resolving the human rights violations perpetrated by
Vietnam against the Indigenous Khmer Krom Peoples who have peacefully protested
against Vietnamese authorities to return them their rice fields and farmlands
confiscated in the I 970s for Vietnamese
people, and resolving the status of Kampuchea Krom territory.
4. Call upon the French Government to
immediately revise and repeal its law no. 49-733 of
4 June 1949 as requested by H.E. Kong Korm, President of the 7th Commission of
the Senate of the Kingdom of Cambodia and strongly supported by
King Norodom
Sihanouk in his public message of 8 June 2003.
5. Call upon the Vietnamese Government
to apologize the Indigenous Khmer Krom Peoples for committing cultural genocide
against Khmer Krom peoples and for oppressing, persecuting, prosecuting,
torturing, false arresting, imprisoning, and extrajudicial killing for decades
and centuries, and diligently cooperate with French Government to return
Kampuchea Krom territory to the Indigenous Khmer Krom Peoples in accordance
with the Charter of the United Nations, Chapters XI, XII. and XIII, the UN GA
resolution 151 4(XV) of 14 December 1960, the UN GA resolution 1541 (XV) of 15
December 1960, the 2001-2010 Second International Decade and its Plan of Action
for the Eradication of Colonialism in the 21st century, and the 13 September
2007 UN Declaration on the Rights of Indigenous Peoples.
6. Call upon the French Government to
apologize the Cambodian Government and the Indigenous Khmer Krom Peoples for
unilaterally in complicity with His Majesty Bao-Dai
of Vietnam transferring on 4 June 1949 its colony of Cochin China, which
belonged to the Kingdom of Cambodia under King Norodom
Sihanouk to Vietnam without consultation with Khmer King and without the
consent of the Indigenous Khmer Krom Peoples, the legitimate and rightful
owners of Kampuchea Krom territory also known as Cochin China in flagrant
violation of the Charter of the United Nations, Chapters Xl, XII, and XIII, of
which France has been full-fledged Member State since 24 October 1945.
7. Call upon the United Nations
Secretary-General, the UN Security Council President and Members, and the UN
General Assembly President and Member States to assist and help in their
respective power the Indigenous Khmer Krom Peoples to regain independence from
Vietnam like the East Timorese people achieving their independence from
Indonesia on 20 May 2002 after living under the colonial power of Portugal for
273 years since 1702 and under the colonial rule of Indonesia for almost 27
years since 1975, the invasion of East Timor by Indonesia.

The right to
self-determination of the Indigenous Khmer Krom Peoples (United Nations General
Assembly Resolution 1541 (XV) of 15 December 1960 and United Nations General
Assembly Declaration on the Rights of Indigenous Peoples of 13 September 2007)
By virtue of
the United Nations General Assembly Resolution 1541 (XV) of 15 December 1960,
the Indigenous Khmer Krom Peoples have three options to choose for their right
of self-determination or self-government as follows;
1. Free association
with Viet Nam, the administering Power that means to self-govern in free
association with Viet Nam and thus to become Vietnamese citizens;
2. Integration
with Viet Nam, the administering Power that means to integrate into Viet Nam
and thus to become also Vietnamese citizens; and
3. independence
that means want to become fully sovereign and fully independent people from
Viet Nam.
And by virtue of article
3 of the United Nations General Assembly Declaration on the Rights of
Indigenous Peoples of 13 September 2007, the indigenous
Khmer Krom Peoples have the right to freely determine their political status
and freely pursue their economic, social and cultural development.
Now, Therefore the indigenous Khmer Krom
Peoples who are the legitimate and rightful owners of their ancestral homeland.
Kampuchea Krom territory or southern Vietnam, formerly French Cochin China,
have their full and legitimate right to freely choose one of the above forms or
models of self-determination for their self-government in accordance with the
international laws.
This
petition will serve as taking a survey of all Khmer Krom people’s political
status or models of self-determination or forms of self-government where all
Khmer Krom people inside Kampuchea Krom territory, all overseas Khmer Krom
people, all Khmer Krom people in Cambodia and everywhere around the world, and
all Khmer people in general can vote for either option number 1, option number
2 or option number 3(independence) for their self-government in strict conformity
with the above UN GA Resolution of 15 December 1960 and UN GA Declaration on
the Rights of Indigenous Peoples of 13 September 2007. This petition-survey
will be sent to the United Nations to urge them to honor the will of the
Indigenous Khmer Krom Peoples regarding their free choice for their
self-government option in accordance with the international laws.
We urge all
Khmer Krom people everywhere in the world to sign this petition-survey with
their full name accompanied by either option number 1, option number 2 or
option number 3 at their own freewill without external compulsion.

that the recognition of the inherent dignity and of the inalienable rights of
all members of the human family to which the Indigenous Khmer Krom Peoples of
former French Cochin China belong is the foundation of freedom, justice and
peace in the world,
Considering
that these inherent dignity, basic human rights, fundamental freedoms, and
inalienable rights to which all Indigenous Khmer Krom Peoples are entitled, by
virtue of the Universal Declaration of Human Rights of 10 December 1948 have

Recalling
the Universal Declaration of Human Rights adopted and proclaimed by the United

Countries to publicize the text of the Declaration and to “cause it to be
disseminated, displayed, read and expounded principally in schools, and other
educational institutions, without distinction based on the political status of

and effective recognition and observance, both among peoples of the United
Nations Member States and among peoples of territories under their

Recalling
the letter to H.E. Ban Ki-moon, UN

1) Putting Kampuchea Krom
or former French Cochin China or southern
Vietnam on the list of the territories still to decide their
future and to get help, assistance and support from the UN Special Committee on
Decolonization;
2) Pressing Vietnam to fully comply with the UN GA
resolutions 15 14(XV) of 14 December 1960 regarding the Granting of
Independence to Colonial Countries and Peoples, the UN GA resolution 1541 (XV)
of 15 December 1960 regarding the option for three different forms or models of
Self-Determination -- Free association with an independent State, Integration
with an independent State and Independence --, the 2001-2010 Second
International Decade and its Plan of Action for the Eradication of Colonialism

that some disparities of opinions exist among Khmer Krom Peoples and Khmer
people in general who are either pro-autonomy model or pro-independence model,
Realizing
that for those who are in favor of autonomy model of self-government, they
freely choose to have incomplete independence for Kampuchea Krom Territory by
putting the territory and its peoples, the Khmer Kroms under the control and
guardianship of the State of Vietnam; and also
Realizing
that for those who are in favor of independence model of self-government or of
self-determination, they freely choose to obtain complete and full independence
for Kampuchea Krom Territory or full sovereignty and full territorial integrity
completely independent from the governing power of Vietnam,
Now,
therefore for the Indigenous Khmer Krom Peoples and Khmer people everywhere
around the world who choose “autonomy” for their self-rule or self-government
shall sign the petition by typing the word “autonomy” in the comments section.

Dear His Excellency
Ki-moon:
At the Sixth Session of the United Nations Permanent
Forum on Indigenous Issues (UNPFII), the Deputy Permanent Representative,
Permanent Mission of the Socialist Republic of Viet Nam to the United Nations, Mr. Nguyen Tat Thanh, in his statement has accused the Khmers Kampuchea Krom
Federation (KKF) and the Montagnard Foundation of having “been engaging in
separatist activities against the State of Viet Nam, including through, inter
alia, spreading false information” and requested the Forum to expel them from
the Forum. Not just this year alone that Viet Nam asked the Forum to get rid of
them, but the past three years as well. This persistent act of Viet Nam is very
inappropriate, irrational and is very contradictory to the spirit of the Forum
because its ultimate goal is to give the opportunities to the indigenous
peoples which are the victims of the administering Power to bring their
concerns, misery, pain, sorrows, suffering which were inflicted upon them by
the administering Power, and their grievances to the attention of the Forum.
As you may know, the Khmer Krom people have been
living in the Southern Vietnam for centuries, known historically as Kampuchea
Krom or French Cochin China, and they have been persistently oppressed,
persecuted, prosecuted, tortured, imprisoned and murdered for centuries by the
successive governments of Vietnam, both the North and the South in order to
wipe them out of the world’s map. France colonized Kampuchea Krom in 1867 and,
when left Indochina, transferred its colony to His Majesty Emperor Bao-Dai of Viet Nam by its law no. 49-733 of 4 June 1949 without the
plebiscite of the Khmer Krom people.
Viet Nam is the current full-fledged Member State of
the United Nations, thus Viet Nam is obligated to abide by its Charter, in
particular Chapter XI relating to the Declaration Regarding Non-Self-Governing
Territories, Chapter XII regarding the International Trusteeship System and Chapter
XIII regarding the Trusteeship Council, and Chapter II, Article 6 regarding
Membership. As Viet Nam has persistently violated the Principles contained in
the UN’s Charter by persistently violating Khmer Krom’s human rights and fundamental
freedoms, Viet Nam may be expelled from this world peace organization (The
United Nations) by the UN General Assembly upon the recommendation of the
Security Council. The granting of the international seat and or floor to Viet
Nam to enable it to continue to mislead the whole world and to continue to
suffer the Indigenous Khmer Krom Peoples is not appropriate. The UNPFII is the
Forum for the indigenous people to bring and express their concerns and
grievances to the attention of the Forum and if their concerns and grievances
have been ignored and rejected, what the Forum is for? So its existence is
senseless and
meaningless because the Forum is biased, is serving
the States, not serving the Indigenous Peoples, not wanted to hear the
grievances and suffering endured by them which were really caused by the States
like the case of the Khmer Krom and the Montagnards.
The two
landmarks UN GA resolutions 1514(XV)of 14 December 1960 and its complement
1541(XV) of 15 December 1960 respectively declare the granting of independence
to colonial countries and peoples and the granting of the options for the right
of self-determination to the Non-Self-Governing Territories and Peoples.
Those
options were:
I) The right to self-determination in free association with the independent State;
2) The right to self-determination in integration
with the independent State; and
3) The right to self-determination in obtaining independence
from the independent
State.
In order to realize these resolutions, the UN GA resolution which
is the 2001-2010 Second International Decade for the Eradication of Colonialism and its Plan of Action was issued requesting the UN
bodies, all NGOs, international organizations, and the administering Power to take necessary measures to
help the Non-Self-Governing Territories and Peoples to exercise their right to
self-determination. But up to date, in spite of the KKF ‘s great efforts to get
help and recognized by the international organizations and nations, the
indigenous Khmer Krom peoples in Kampuchea Krom, the Southern Viet Nam, the
Mekong Delta Region, still suffer tremendously and inhumanely from the
successive Vietnamese governments’ persistent oppressions, persecutions,
prosecutions, tortures, imprisonments, and murders. Their lands, rice fields,
farmlands, Buddhist temples, houses are being taken away for the Vietnamese
people and for the State or destroyed without any compensation under the pretext of expropriation for cause of
public utility or else. Viet Nam still turns its blind eyes on the
international laws and continues to violate Khmer
Krom’s human rights and fundamental freedoms. Whereas the UN bodies on the situation never, ever take any necessary measures to ask or pressure Viet
Nam to comply
with these International Iegal instruments and laws. If these human
rights violations continue to persist against Khmer Krom people who are the
rightful and legitimate owners of the Territory, the victims Khmer Krom will
rise up one day that really causes the instability of the region. So Southeast
Asia will be burned again by the nationalist war of
the indigenous peoples against the
oppressors, persecutors, prosecutors, torturers, and murderers. And no one can claim that it’s a
terrorist activity or else because the UN and other great and small nations
need to very well define rightfully who is or who are the real terrorist. In
Buddhist way or teachings, the ones who cause the sufferings to others are called
“Mara”
or in modern term the” Terrorist”. Therefore, Viet Nam who persistently causes
endless cruel sufferings to the indigenous Khmer Krom Peoples through the use
of various forms and acts of violence by terrorizing them for centuries is the
very real terrorist.
To understand Viet Nam better, Your Excellency needs to plan for a
UN visiting mission to the Mekong Delta Region where a great and large number of
Khmer Krom people and communities have been living there for thousands of years
before the establishment
of the State of Viet Nam in
order to investigate the real situation to find out
the truth because truth is sacred, truth is universal, truth is
never, ever changed over time; truth is always born deeply within the victims’
hearts, minds, spirits and souls, not within those of the oppressors, the “Mara” who persistently sow all the suffering, misery, pain. Sorrows, worries, and fear
over the victims. These are all greed, hatred and delusion within the
oppressors’ bodies, minds, spirits and souls to eradicate the victims’
language, culture, customs and traditions, in short to Vietnamize
them (Please refer to the documentary film “Eliminated
Without Bleeding” by Ms. Rebecca Sommer.
Based on the bodies of burden evidence either extrinsic,
documentary, historical, real, circumstantial, cumulative, direct,
demonstrative, opinion and/or eyewitness, I would like to suggest to Your
Excellency to reconsider your decision
about the membership status of Viet Nam to the United Nations. If the United
Nations continues to accept Viet Nam as Member State, the UN needs to put
pressure on Viet Nam to abide by the Charter of the United Nations and all the UN GA
resolutions relating to the exercise of
the right to self-determination by the Non-Self-Governing Territories and
Peoples in accordance with all the provisions and dispositions
prescribed in the two landmarks UN GA resolutions
1514(XV) of 14 December 1960, 1541(XV) of 15 December 1960 and the 2001-2010 Second
International Decade for the Eradication of Colonialism in the 21st
century and its Plan of Action and the UN Human Rights Council Proclamation.
And also I would like to point out to Your Excellency about the silent attitude,
behavior and character of Viet Nam
regarding the UNPO ‘s letters of 2 September
and 5 September 2003 appealing Prime Minister Pham Van Khai of Vietnam to have dialogue
regarding the six grievances brought by the Khmers Kampuchea Krom
Federation( KKF) against Viet Nam and to consider the request to decolonize Kampuchea Krom and place it under
the control of the United Nations in order to prepare for a self-determination referendum, allowing Khmer Krom peoples to choose for their
options of self-determination, either internal or external self-determination because the
ultimate goal is the establishment of a free and fair political environment and
a stable peace in the region. I would like also to include in this letter, for
your information and acknowledgment, a 54-year
report of the KKF ‘s late President Son Tuon describing all the cruel suffering endured
by the Khmer Krom people and the extrajudicial killings of the Khmer Krom
Buddhist monks under the Colonization rules of Viet Nam.
Recently, a group of 120 Indigenous Khmer Krom Peoples of Moat
Chrouk province (An Giang province in Vietnamese), after unsuccessful attempts
to demand the return of their 500 hectares of farmlands which were confiscated
several years ago by the Vietnamese authority from all different local levels
of the Vietnamese authorities - villages, communes, districts, and province-
had decided to bring their complaint to the highest Vietnamese authority in Ho
Chi Minh City ( Prey Nokor City in Khmer) for a peaceful resolution to their
demand for the return of their confiscated farmlands. But the Vietnamese
authorities did not allow them to go by cars and also confiscated two motorbikes
from them and forced them to walk on foot to HCMC which is more than 300
kilometers long that took them several days to get there. Only a group of about
30 protesters were able to secretly reach Prey Nokor
City to hand over their petitions to the Vietnamese Prime Minister to
ask for help in the resolution of their confiscated lands as per Radio Free
Asia’s report.
These grave flagrant human rights violations by the Vietnamese
government against the Indigenous Khmer Krom Peoples shall not be overlooked by
the United Nations to which Viet Nam is the current full-fledged Member State
and by the US State Department. How can the “minority people freely travel to
US embassy in Hanoi” as promised to Ellen Sauerbrey, the US Assistant Secretary
of State for Population, Refugees, and Migration by the Viet government (RFA)?
The UN needs to reconsider the membership status of the State of Viet Nam to
the United Nations(Chapter II, Article 6 regarding Membership), and the US
government needs to reinstate the CPC and to reconsider the granting of
Permanent Normal Trade Relation(PNTR) and the endorsement on the admission of
Hanoi into the World Trade Organization (WTO) for Hanoi’s persistent violations
of human rights and fundamental freedoms of the Indigenous Khmer Krom Peoples
and of the persistent violations of the Principles contained in the UN Charter,
Chapter II, Article 6 regarding Membership. The UN needs to review the past
mistake when admitting the Khmer Rouge regime into the United Nations by
granting the international floor to the Khmer Rouge leader, Ieng Sary to lie to the world that Khmer people under
their regime ate three times a day including dessert Ironically, the Khmer
Rouge in different levels of leadership treated the Khmer people like animals.
About two million people died from hardships, starvation, diseases, and mass
execution. The UN relied only on their cheap lies and never ever did the
investigation on the situation and checked on the Khmer Rouge activities to see
if their statements were credible or not. Therefore, to help the Indigenous
Khmer Krom Peoples to exercise their right to self- determination and to have
their human rights and fundamental freedoms been respected, the UN shall
periodically check on Viet Nam’s promises, activities and performances in
regard to all indigenous minorities and all other minority people inside Viet
Nam, in particular the Khmer Krom and the Montagnards people.
Finally, I would like to urge
Your Excellency Mr. Secretary-General to consider the following suggestions for
the United Nations’ future agendas and missions:
• Put
Kampuchea Krom or former French Cochin China or Southern Viet Nam on the list
of the territories still to decide their future and to get help, assistance and
support by the United Nations’ Special Committee on Decolonization;
• Pressure Viet Nam to fully comply with the above-mentioned
international laws and to reconsider the two letters of the UNPO of 2 and 5
September 2003 requesting Viet Nam to decolonize Kampuchea Krom and to
place it under the control of the United Nations for the preparation of
the self-determination referendum allowing the Khmer Krom people to
choose among the options stipulated in the above-mentioned UN GA resolution
I541(XV) of 15 December 1960
• Envisage the missions
of the UN Special Rapporteurs on the situation of
Human Rights, Religious
Freedoms, Political, Social and Economic
Development, Cultural
and Educational Advancement, Natural
Resources, etc. to the
Mekong Delta Region where the indigenous Khmer
Krom Peoples are living
in greater communities;
• Help to set up
dialogue(s) with Viet Nam, the administering Power regarding the decolonization of Kampuchea Krom and
place it under the control of the United Nations; and
• Plan for a
self-determination referendum allowing the Khmer Krom Peoples to use their own
free will for their self-government like the UN used to do for the Tokelau
people in New Zealand and the East Timor people in Indonesia.
Hoping Your Excellency Mr. Secretary-General spending a little bit
of your busy time to review the Khmer Krom Peoples’ case in Southern Viet Nam
who have been living on their own motherland for centuries under the cruel
colonization rules and the atrocities of the State of Viet Nam and to take into
consideration all the UN GA resolutions regarding the right to
self-determination of the indigenous peoples, the UN Charter, in particular
Chapters XI, XII and XIII, the UNPO’s letters and a 54-year report of the
Khmers Kampuchea Krom Federation (KKF), would you please, Your Excellency Mr.
Secretary-General, accept from the bottom of my heart my deepest respect and

IN HUMAN AFFAIRS” at the opening of the 2007 session of the Special
Committee on decolonization in New York, 22 February, I ask your permission to
submit to you a copy of my letter to H.E. Ban Ki-moon and its attachments regarding
the indigenous Khmer Krom peoples whose human rights and fundamental freedoms
have been continuously and persistently violated by the successive Vietnamese
governments for centuries, both the North and the South in their black and
vicious intentions to wipe them out of the world’s map.
Recently on 30 June 2007, the Venerable Tim Sakhorn, Abbot of Watt Phnom Den North in Takeo
province, Cambodia who has been accused of ruining friendship
relation between Cambodia and Vietnam has been defrocked and forced into a car
by secret body guards and drove away to Viet Nam. Up to date his whereabouts
are still a mystery. The Venerable Tim Sakhom is a Khmer Krom Buddhist monk who was forced
to flee Kampuchea Krom or Southern Viet Nam in 1978 for fear of persecution by
the Vietnamese authority.
My letter and its attachments such as the 54-year report of the Khmers
Kampuchea Krom Federation (KKF) and the two letters of the UNPO dated respectively 2
September and 5 September 2003 regarding the request to decolonize Kampuchea Krom and place it
under the control of the United Nations must be paramount evidencing that the
Khmer Krom people are the indigenous peoples of that territory for thousands of
years even though Viet Nam is trying recently to mislead its own people and the
world by publishing a short history book of the Southern Viet Nam or Kampuchea
Krom (Former French Cochin China) that Kampuchea Krom belongs to Viet Nam.
Your Excellency Deputy Secretary-General,
Your above-mentioned remarks are extremely powerful. The Special
Committee on decolonization needs to work hard and all the UN bodies, all
administering Powers and all international organizations on the situation need
to cooperate with each other to bring about a speedy, successful and sustainable solution
for the total eradication of colonialism.”
I urge Your Excellency to include Kampuchea Krorn or Former French
Cochin China or Southern Viet Nam (The Mekong Delta Region) on the
list of the Non-Self-Governing
Territories to decide their future in accordance with the UN Charter,
Chapters XI, XII and XIII, the UN GA resolution 1514(XV) of 14
December 1960, the UN GA resolution 1541(XV) of 15 December 1960 and the
2001-2010 Second International Decade for the Eradication of Colonialism and
its Plan of Action.
Whereas the place of Viet Nam at the United Nations as a Member
State or Member Nation, I would suggest Your Excellency to reconsider its Membership regarding its persistent
violations of the Principles
contained in the UN Charter by persistently violating the indigenous Khmer Krom
peoples’ human rights and fundamental freedoms for centuries in its black
schemes to wipe them out, to vietnamize them against their free will as human
beings and against the international law.
The non-violent struggle movement of Khmer Krom, the Indigenous
Peoples of the Southern Viet Nam is moving on forward without interruption,
heavily armed with the international law as their legal and powerful weapons
until they reach successfully their self-government through their chosen option
stipulated by the UN GA resolution 1541(XV) of 15 December 1960.
Based on the factual data, extrinsic, documentary and historical
evidence revealed by the 54-year report of the KKF and the two letters of the
UNPO of 2 and 5 September 2003 to H.E. PhanVan Khai, Prime Minister of the Socialist Republic of
Vietnam, I respectfully implore Your Excellency Deputy
Secretary-General to pressure Viet Nam to stop violating Khmer Krom’s human
rights and fundamental freedoms, to recognize them as the indigenous peoples of
the territory and to reconsider the appeal and the request of the UNPO

Vietnam is a member of the United Nations, therefore

These
ongoing, continuous and non-stop violations of human rights and fundamental
freedoms of our indigenous Khmer Krom peoples perpetrated by Vietnam must be stopped,
blamed and
severely punished by the international community and all the
freedom-democratic loving countries around the world. But instead of charging
the perpetrator with those persistent human rights violations against our
indigenous Khmer Krom peoples, the international community seems to ignore or
not pay much attention to the very long lasting sufferings of our indigenous
Khmer Krom peoples who have been suffered for centuries of persecution,
prosecutions, torture, false arrest and imprisonment, population transfer,
racial hatred, and extrajudicial killings. All of these crimes committed by
Vietnam against our Khmer Krom people have one thing in common to serve the
black scheme of Vietnam: the total eradication of Khmer Krom people’s race on
their own motherland, Kampuchea Krom also known as former French Cochin China
or Southern Vietnam.
The peaceful
demonstrations of Khmer Krom Buddhist monks in Khleang province (Soc Trang in
Vietnamese) and in Cambodia to ask Vietnam to stop defrocking and to release
Khmer Krom Buddhist monks from jails, the murder of Khmer Krom Buddhist monk,
the Venerable Eang
Sok Thocun in Cambodia after the peaceful protest in front of the
Vietnamese embassy in Phnom Penh, the murder of a Khmer Krom’s newspaper editor
in Phnom Penh, Cambodia, and recently the defrocking of the Venerable Tim Sakhorn,
Abbot of Watt Phnom Den North in Takeo province and forced him into a car
heading Vietnam whose whereabouts are still a mystery are all, with no doubt, masterminded by Vietnam.
Your
Honorable Secretary of State,
I am asking your permission to submit to your highest information
and eventual decision copies of my letters to H.E. Ban Ki-moon, the UN
Secretary-General and H.E. Asha-Rose Migiro, the UN Deputy
Secretary-General and their attachments such as a 54-year report of the Khmers
Kampuchea Krom Federation (KKF) and the 2 and 5 September 2003 UNPO’s letters
regarding the issues of the indigenous Khmer Krom peoples of the Mekong River
Delta region or former French Cochin China or Kampuchea Krom, their motherland.
By going over all of these documents thoroughly, Your Honorable may have seen
the real “Truth” about who are the real “Victims” and who are the real” Mara”
or real” Terrorists” or real “Victimizers”? Truth is Buddha’s teaching, sacred,
and universal; it is never ever changed over time no matter what happens in all
human beings lives. Vietnam who causes endless sufferings to all Khmer Krom
people who are the legitimate owners of the Non-Self-Governing Territory,
Kampuchea Krom or former French Cochin China that France’s President Vincent
Auriol had illegally transferred to Vietnam’s Emperor, His Majesty Bao-Dai by French law no. 49-733 of 4 June 1949
without the plebiscite of Khmer Krom people merits punishment by the
international community instead of providing them with the international arena,
the international seat at the United Nations to voice its cheap and dirty lies
to the world that Khmer Krom people are minorities in small number among other
minorities in Vietnam. Recently, Vietnam has published a short history book
telling its own people that Kampuchea Krom or French Cochin China or Southern
Vietnam belongs to Vietnam for thousands of years and Khmer Krom people had
established their families in that territory after the Vietnamese people. Your
Honorable may have seen very clearly the duped and unshameful attitude of
Vietnam to mislead its own people and the world into believing in what is not
real, not true, in what it’s just made up for the form sake. For this reason,
should Vietnam be rewarded with the PNTR and the WTO or else? To the eyes of the victims it is not
fair at all because the victimizer(s) feel encouraged to pursue its devil and
evil deeds again and again without interruption.
The UNPO’s
document distributed at The Hague International Conference from 29 September to 01
October 2006 “The Right to Self-Determination in International
Law”
has mentioned “The international community, its members and institutions have
an obligation to act where international law, including human rights and especially
the right to
self-determination, is violated.
The time to
act is always now, not when a conflict is “ripe” for resolution, as
some would have it.”
Owing to this important idea of the UNPO regarding the violations of
Khmer Krom people’s human rights, fundamental freedoms and the right
to self-determination by the Socialist Republic of Vietnam, the United Nations,
all member States and/or member Nations and all the international organizations
have the obligations
to act right now to help the indigenous Khmer Krom peoples to exercise their
right to self-determination and to punish Vietnam for its persistent human
rights violations against Khmer Krom people in flagrant violation of the
international law, in particular the Charter of the United Nations, Chapters XI. XII and XIII. the UN GA
resolution 15141XV1 of 14 December 1960, the UN GA resolution 1541(XV of 15
December 1960 and the 2001- 2010 Second International Decade for the
Eradication of Colonialism in the 2ls century and its Plan of Action.
Greatly hope that Your Honorable Secretary of State takes into
consideration all ideas, suggestions and requests generated from all submitted

Dear His Excellency Ambassador:
I am writing to implore for your kindness and generosity to
intervene immediately with the Vietnam’s government to immediately release nine (9) indigenous Khmer
Krom Buddhist monks who have been recently defrocked and jailed by Vietnam’s
authority in Khleang province ( Soc Trang in Vietnamese) and re-ordain them as
Buddhist monks in accordance with Vietnam’s constitution, UN Charter, Human
Rights Council’s Proclamation, articles 1, 2,3 and 29..., UN GA resolutions
1514 (XV) and 1541 (XV) of 14 & 15 December 1960 relating to the
granting of independence to Colonial Countries and Peoples and the right to
self-determination of the Non-Self-Governing Territories and Peoples, the
2001-2010 Second International Decade and its Plan of Action relating to the
Eradication of Colonialism in the 2l century.
As your Excellency knows, Khmer Krom is the Indigenous Peoples who
have been living in the territories and lands for thousands of years. France
colonized Kampuchea Krom or Cochin China in 1862.
When left Cochin China or Kampuchea Krom, France had transferred
its colony of Cochin China to Bao-Dai, Vietnam’s Emperor on 4 June 1949 by its law no. 49-733 of
June 4, 1949, signed by French President Vincent Auriol,
modifying the status of its colony Cochin China in the French Union without the
consent of Khmer Krom people. Since then, Vietnam tries by all means to wipe
out Khmer Krom people from the world map---population transfer, forced racial
assimilation, false accusation and arrest, imprisonment, torture, murder,
religious and political persecutions and prosecutions, mass killing, mass
drowning (Vinh Te Canal), mass burning in nine (9) Japanese rice
barns/warehouses in Khleang province,
Pol Leav province and Toek Khmao province. These are gross violations of Human
Rights and Fundamental Freedoms against Khmer Krom, the Indigenous Peoples of
the Mekong River Delta region (southern part of Vietnam) committed by Vietnam
for centuries without interruption, without respecting any international laws,
any UN GA resolutions, Human Rights Law, and UN Charter for which Vietnam is a
member State.
Vietnam continues to persecute Khmer Krom people from one
government to the next by ignoring the international law and by misleading the
whole world that Khmer Krom people are minorities in small number like the
other minorities in Vietnam. But in reality, Khmer Krom people are the
legitimate owners of Cochin China or the Mekong River Delta region or southern
part of Vietnam,
Vietnam is a current UN’s Member State; it needs to abide by the
above-mentioned International Law. If not, the UN and its member nations shall
put pressure on Vietnam to stop once and for all its incessant flagrant
violations against the Indigenous Khmer Krom Peoples and to respect
unconditionally Khmer Krom Peoples’ fundamental rights and freedoms as the
legitimate owners of the 21 provinces that Vietnam changed their original
Khmer names into Vietnamese names such as Prey Nokor to Saigon then to Ho Chi
Minh City, Preah Trapeang province to Travinh, Peam province to Hatien, Khleang
province to Soc Trang in Vietnamese, etc...
We strongly urge Your Excellency to demand Vietnam to immediately
stop its violations against Khmer Krom civilians and Khmer Krom Buddhists monks
and recognize them as the Indigenous Peoples of their ancestral territories and
lands and stop depriving them of their inalienable and sovereign rights as the
legitimate owners of Kampuchea Krom or former French Cochin China, their
homeland.
Thank you in advance for your urgent assistance and cooperation to
save Khmer Krom, the Indigenous Peoples of the Mekong Delta region, their
motherland.

Permanent Missions to the United Nations:
1 would like
your highest permission to respectfully submit a Petition for your highest
consideration and urgent intervention in favor of the Indigenous Khmer Krom
Peoples who have been unjustly and tremendously suffered from the successive
Vietnamese governments violations of their human rights, their fundamental
freedoms and their right to self-determination in accordance with the
international law.
As your
Excellency knows and the whole world also knows, the Indigenous Khmer Krom
Peoples are the legitimate owners of the Southern Vietnam that is also known as
former French Cochin China or Kampuchea Krom in Khmer. France colonized that
Territory in 1867 and transferred it illegally to the Vietnamese emperor Bao-Dai by French law no.
49-733 of 4 June 1949 without the plebiscite and or consent of the
legitimate and rightful owners, the Khmer Krom Peoples.
Under the
successive Vietnamese governments, both the South and the North, the Indigenous
Khmer krom Peoples have been suffered too much of persistent oppressions,
persecutions, prosecutions, arbitrary arrest and imprisonment, torturing and
extrajudicial killings in its vicious intentions to totally eradicate their
identities and race. But from one generation to the next, the Indigenous Khmer
Krom Peoples resist valiantly to these Vietnamese governments’ aggressive and
inhumane attempts to eliminate Khmer Krom’s identities and race by fighting
them back through both means, violent and non-violent or peaceful, in order to
keep their culture, language, customs and traditions alive despite the
successive Vietnamese governments tried by all means to vietnamise them(to make
them Vietnamese) by changing their last names, their villages, communes,
districts, and provinces names into Vietnamese names such as Prey Nokor City to
Saigon and then to Ho Chi Minh City today. But whatever Vietnam did, is doing
and will be doing to mislead the world about Khmer Krom Peoples and their
history, Vietnam is not going to succeed in its evil attempts.
Most
recently, the Venerable Tim Sakhorn, Abbot of
Watt North Phnom Den in Kirivong district, Takeo province, Cambodia was accused
of undermining the good friendship relation between Cambodia and Vietnam, of
using the pagoda, the temple for serving the Khmers Kampuchea Krorn
Federation(KKF), and of crossing illegally the border to Vietnam even though
Vietnam claimed him citizen of Vietnam.
Due to the persistent human rights
violations of Vietnam against the Indigenous Khmer Krom Peoples, the
Montagnards, the Hmongs, and other ethnic minorities groups and other people as
well in Vietnam, Vietnam does not deserve at all the honored international seat
at the United Nations to propagandize its cheap and dirty lies to the world
that the human rights have improved in Vietnam, but in reality they are not.
The recent adoption of the United
Nations Declaration on the Rights of Indigenous Peoples by the United Nations
General Assembly on 13 September 2007 will serve as a legal international
instrument to force Vietnam to abide by all the provisions, stipulations and
principles contained in the Declaration regarding especially the Indigenous
Peoples’ human rights and fundamental freedoms, and their rights to their
lands, territories and resources. Despite the support of Vietnam for the
Declaration, the United Nations and the international community need to keep
their eyes constantly on Vietnam for Vietnam often violated what it has
promised and signed. But with your urgent intervention and or action against
Vietnam’s persistent human rights violations, I greatly hope that the watchful
and careful application, implementation and execution of that Declaration by
the United Nations, the international community and by Vietnam itself will
gradually improve the human rights, the fundamental freedoms and the right to
self-determination of the Indigenous Khmer Krom Peoples. But in the event that
the violations still persist in regard of all the existing international law,
the only and only alternative will be the severe punishment of Vietnam by the
United Nations and the international community.
Now it is time for the United Nations
and the international community to closely monitor the flip-flopping attitude
and behavior of Vietnam, its promises and activities to see how much Vietnam is
going to hold on to its promises and to execute the Declaration in favor of the
Indigenous Khmer Krom Peoples and other minorities groups in Vietnam.
I urge Your Excellency Permanent Mission
to help and assist the Indigenous Khmer Krom Peoples who are the legitimate and
rightful owners of Kampuchea Krom (Southern Vietnam) by taking into
consideration the requested sixteen-key points in the enclosed Petition.

I am forwarding to Your Highest
Excellencies again our Khmer Kampuchea Krom Association’s petition regarding
the ongoing non-stop violations of the State of the Socialist Republic of
Vietnam against our indigenous Khmer Krom Peoples’ human rights, fundamental
freedoms and the exercise of their right to self-detennination in international
law.
Our first wishes and demands in favor of
our long lasting suffering Indigenous Khmer Krom Peoples in Southern Vietnam or
Kampuchea Krom (French Cochin China) to Your Highest Excellencies for urgent
actions against Vietnam’s flagrant violations were dated back to Wednesday,
March l4,2007, Tuesday, July 24 and Wednesday, July 25,2007, Tuesday, 11&25September,2007.
Right now, the violations still persist, still alive without fearing of the
existing international law still in full force. Recently Hanoi has prevented
from flying to Vietnam two EU MPs, H.E. Marco Panella and H.E. Marco Perduca
for looking into the case of Indigenous Khmer Krom Peoples’ human rights violations
and that of other groups by the State of Vietnam. How dare Vietnam continues to
Violate people’s rights and especially the rights of the Indigenous Khmer Krom
Peoples and the world seem to be afraid to take any appropriate and concrete
urgent measures against such a kind of daredevil Vietnam? The UNPO’s document
stated, “The international community, its members and institutions have an
obligation to act where international law, including human rights and
especially the fight to self- determination, is violated. The time to act is
always now, not when a conflict is” ripe” for resolution as some would have
it.” And the UN Deputy Secretary-General, Dr.
Asha-Rose Migiro said at the 22 February 2007 Session of the UN Special
Committee on decolonization,” Pragmatic Steps Needed to Close Colonial Chapter
in Human Affairs” to bring about a speedy, successful and sustainable solution
for the total eradication of colonialism.”
Dear Your Highest Excellencies Permanent
Missions to the United Nations, please take some urgent measures under your
power as legitimate representatives of your own nations and people to curb the
SRV government to abide by the international law as Vietnam is the full-fledged
Member State/Member Nation of the UN and also sits at the UN Security Council
for two years as a non-permanent member.

Dear Your H.E. Ambassadors Extraordinary and Plenipotentiary
Permanent Missions to the United Nations:
Your Highest Excellencies, Permanent Missions to the United
Nations, please help the indigenous Khmer Krom peoples to
freely exercise their right to self-determination and independence in
accordance with the international laws, especially in accordance with the UN Charter, Chapters XI, XII and XIII, the UN resolution
1514(XV) of 14 December 1960 regarding the Granting of Independence to Colonial
Countries and Peoples, the UN resolution 1541(XV) of 15 December 1960 regarding the option for either one of the three
different forms or models of self-determination, the 2001-2010 Second
International Decade and its Plan of Action for the Eradication of Colonialism,
and lastly the UN GA Declaration on the Rights of Indigenous Peoples of 13
September 2007 whose Article 3 has stated,
“Indigenous peoples have the right to self-determination. By virtue of that
right they freely determine their political status and freely pursue their
economic, social and cultural development.”
Their long lasting abyss of cruel sufferings imposed by the
successive governments of Viet Nam, both the South and the North has been
caused by the unilateral and illegal transfer by France of its colony of Cochin
China also known as Kampuchea Krom to Bao-Dai of Viet Nam by French President Vincent
Auriol on 4 June 1949:
Law no. 49-733 of 4 June 1949 without any consultation with the
King of Cambodia, His Majesty Norodom Sihanouk and without the consent of the
legitimate and rightful owners of the territory and lands, the Khmer Krom
peoples.
This illegal and unilateral action and decision of France was in
flagrant violation of the Chapters XI, XII and XIII of the Charter of the
United Nations of which France has been Member State or Member Nation since 24
October 1945. France must apologize the Khmer King and Khmer government and the
Khmer Krom peoples for her illegal action and decision by unilaterally
transferring her colony of Cochin China to Bao-Dai
in complicity with him and must repeal its law no.
49-73 3 of 4 June 1949 and return Kampuchea Krom territory
unconditionally to the legitimate and rightful owners, the Khmer Krom peoples
to avoid possible International Court of Justice legal proceedings to be brought by Khmer Krom
peoples in the future. In the new era of Information,
Sciences and Technology, “La Lol Du Plus Fort Est Toujours La Meilleure” of La Fontaine won’t work any more for
the members of the human family on this planet Earth. All
evil minds need to be severely blamed and punished by the international
community. There is no exception at all for the tyrants and terrorists! God’s
people will put all the tyrants and terrorists under their feet.

Due to the persistent human rights violations

Khmer, I would like to submit the attached documents for Your Excellency to
review and take the necessary measures to pressure Vietnam to stop violating
once and for all the Indigenous Khmer Krom People& human rights and

Emperor Bao-Dai on 4 June 1949 have been
suffered tremendously by the Vietnamese successive governments.
Your Excellency can learn more about the cruel suffering of the Khmer Krom
People and the atrocities of the Vietnamese successive governments through a 54-year report
under the
colonization of Vietnam by the Khmers Kampuchea Krom Federation
(KKF) herewith attached. All factual data revealed by this report are sufficient
evidence to send Vietnam to the International Court of Justice( ICJ) for its
ongoing continuous and non-stop human rights violations and crimes against the
Indigenous Khmer Krom Peoples of the Southern Vietnam or Kampuchea Krom. their
ancestral territory and land, Vietnam which persistently violates the Principles
contained in the UN Charter deserves the punishment by this world body and the
international community.
Therefore, the granting of the international seat to Vietnam needs
to be reviewed by the UN General Assembly, and all Member Nations need to
reconsider the membership of Vietnam in accordance with Chapter II, Article 6
of the UN Charter.
Please SOS the Indigenous Khmer Krom Peoples before it’s
too late from the atrocities of Vietnam.

and assistance the attached documents relating to the persistent human rights
violations committed by the successive Vietnamese governments against our
Indigenous Khmer Krom Peoples of the Southern Vietnam or French Cochin China
also known as Kampuchea Krom,, the ancestral territory and land of the
Indigenous Khmer Krom Peoples, the legitimate owners of the Mekong River Delta
region.
As you already know as you go back to the past century, the
President of France, H. E. Vincent Auriol had signed a law no. 49-733 of 4 June
1949 chin China
or Kampuchea
Krom in Khmer to His Majesty Ban-Dai the Vietnamese Emperor
without any plebiscite of the Khmer Krom people. This unanimous action of the French
government was totally inappropriate and unacceptable because it was in
flagrant violation of the international law and the freewill of the legitimate
owners, the Indigenous Khmer Krozn Peoples of the Mekong River Delta region.
From then., on and on, the Vietnamese governments, both the North and the South
have been trying by all means to wipe them out of the worlds map trough forced
population transfer, last names changes, villages, communes, districts and
provinces names changes such as Prey Nokor has been changed to Saigon and then
now to Ho Chi Mirth City, false arrest and imprisonment, persecution,
prosecution, torture and extrajudicial killings etc Recently the Venerable Tim
Sakhorn, the Abbot of Watt Phnom Den North in the Takeo province, Cambodia has
been brutally defrocked and forced into a car by the secret body guards heading
to Vietnam. Up to date his whereabouts are still a mystery despite the
reactions of his immediate family, those of the Khmer Kampuchea Krom community,
the UN Representative, the U.S. Embassy and those of the international
community and the NGOs inside Cambodia and abroad.
In accordance with the Charter of the UN, Chapters Xl, XII and XIII, the UN GA resolution
1514(XV) of 14 December 1960, the UN GA resolution 1541(XV) of 15 December
1960 and the 2001-2010 Second International Decade for the
Eradication of Colonialism in the 21st century and its Plan of Action,
Vietnam is obligated
to abide by the above mentioned international law by cooperating with the UN
bodies especially the UN Special Committee on decolonization and the other
international organizations to recognize Khmer Krom people as the Indigenous
Peoples of the territory helping them to exercise their right to self-determination in the
international law, in particular the UN GA resolution 154 1(XV) of 15 December
1960 authorizing them to choose among the three options of self-government
either Free
association with the independent State, either Integration with the independent
State or
Independence whichever will he suited to their freewill as Peoples.
Your Excellency, up to today the French law no. 49-733 of 4 June
1949 is a little bit over 58 years old,
but the
suffering of the Indigenous Khmer Krom Peoples is tremendous and the
crimes committed by the successive
Vietnamese governments are countless. I urge Your Excellency to request
the French government to repeal the above-mentioned law and return the
territory and land back to the legitimate owners, the Indigenous Khmer Krom
Peoples of the Mekong River Delta region in accordance with the spirit,
the provisions,
the dispositions
and the principles of those existing and current
international law above mentioned.
I count on Your Exce1lencys urgent intervention, help and
assistance in favor of the more than 13 millions indigenous Khmer Krom Peoples
in Southern Vietnam by using your legitimate power as the Permanent
Representative of France to the United Nations to put political, economic,
cultural pressure or else on Vietnam to stop once and for all its human rights
violations against the Indigenous Khmer Krom Peoples and willingly cooperate
with the international community to help Khmer Krom people to realize their
self-government in accordance with the above international law still in force.

consider the letters of the UNPO to H.E. Phan Van Thai, Prime Minister of the
Socialist Republic of Vietnam dated respectively 2 and 5 September 2003
regarding the decolonization of Kampuchea-Krom and put it under the control of
the UN and my letter of Monday, July 2, 2007 urging Your Excellency to consider
a number of suggestions to assist the indigenous Khmer Krom peoples for the
same above purpose.
I greatly hope that Your Excellency is
very sensitive to the concerns, aspirations and will of the indigenous Khmer
Krom peoples who are the rightful and legitimate owners of the Kampuchea-Krom
territory that France under President Vincent Auriol had illegally ceded
Kampuchea-Krom, the Homeland of the indigenous Khmer Krom peoples to emperor
Bao-Dai of Vietnam without the consent of the Khmer King and the indigenous Khmer
Krom peoples by France’s law no. 49-733 of 4 June
1949 in flagrant violation of the international law, the Charter of the
United Nations of which France has been Member State since 24 October 1945. This illegal and unjust action of
France against the indigenous Khmer Krom peoples has been the cause of endless
sufferings and agonies of our indigenous Khmer Krom peoples for generations and
generations. Our Khmer Krom people who are the real owners of the lands,
territories and resources urge Your Excellency to utilize all the international
laws to help them exercise their right to self-determination and to freely
determine their political status in pure
conformity to those said international laws.

Annex 16: A
crime against humanity of Vietnam’s Police authorities perpetrated against a
young Khmer Krom woman who led the Khmer Krom farmers in An Cu village, Tinh
Bien district, An Giang province in 2008 to demand the return of their
confiscated farmlands got beaten by Vietnamese police forces with electric
baton till unconscious for one day. From
then on she became critically ill and was discriminated against by and ignored
for her treatment at the hospital in Prey Nokor
(renamed Saigon by Vietnam) and in Tri Ton town in Tri Ton district. She passed away on Saturday, 25 September
2010 due to the impact of Vietnamese police forces’ brutalities.
